Build.Shop Mobile Application Terms and Conditions

Welcome to Build.Shop Mobile Application (the "App"). This document outlines the terms and conditions governing the User's use of the App. By downloading, installing, or using the App, the User agrees to be bound by these terms. If the User does not agree with any part of these terms, please do not use the App.

1. Definitions

- "User": Refers to any individual who downloads, installs, or uses the Build.Shop Mobile Application.

2. Acceptance of Terms

By using the App, the User acknowledges that they have read, understood, and agree to comply with these Terms and Conditions, as well as any additional terms and policies referenced herein or available within the App.

3. License

Build.Shop grants the User a limited, non-exclusive, non-transferable, revocable license to use the App for personal and non-commercial purposes in accordance with these Terms and Conditions.

4. User Accounts

To use this App, the User is required to use their Build.Shop CMS login credentials. The User is responsible for maintaining the confidentiality of their account information and for all activities that occur under their account. The User agrees to provide accurate and complete information when creating their account.

5. Copyrighted Material

5.1. User's Responsibility:

The User acknowledges and agrees that they shall be solely responsible for any copyrighted material uploaded onto Build.Shop servers. The User represents and warrants that they have obtained all necessary permissions, licenses, or authorizations from the rightful copyright owner(s) to use such copyrighted material within the Software.

5.2. Compliance with Copyright Laws:

The User shall ensure that the use of copyrighted material complies with all applicable copyright laws and regulations. Build.Shop shall not be responsible for any infringement of copyright arising from the User's use of the Software.

5.3. Indemnification:

The User agrees to indemnify, defend, and hold Build.Shop harmless from and against any claims, losses, damages, liabilities, and expenses, including reasonable legal fees, arising out of or related to the User's uploading and use of copyrighted material in violation of this Agreement or any applicable copyright laws.

5.4. Removal of Infringing Material:

Build.Shop reserves the right to remove or disable access to any material that it believes, in its sole discretion, may infringe upon the intellectual property rights of others, including but not limited to copyrighted material. Build.Shop shall not be liable for any damages, losses, or expenses incurred by the User or any third party as a result of the removal or disablement of such material.

5.5. Termination:

In the event of repeated violations of this clause or any other provision of this agreement related to intellectual property, Build.Shop reserves the right to terminate the services provided to the User.

5.6. Survival:

This clause shall survive the termination or expiration of this Agreement.

6. Prohibited Activities

To use certain features of the App, the User may be required to create an account. The User agrees not to engage in any of the following activities:

a. Violating any applicable laws or regulations.

b. Using the App for any illegal or unauthorized purpose.

c. Attempting to gain unauthorized access to the App or its related systems.

d. Transmitting any malicious code, viruses, or harmful software.

e. Violating the intellectual property rights of others.

7. Privacy

The User's use of the App is also governed by our Privacy Policy, which can be found link to Privacy Policy. By using the App, the User consents to the collection, use, and sharing of their information as described in the Privacy Policy.

8. Updates and Changes

Build.Shop may update or change the App, including these Terms and Conditions, at any time without prior notice. It is the User's responsibility to review the terms periodically. Continued use of the App after changes constitutes acceptance of those changes.

9. Termination

Build.Shop reserves the right to terminate or suspend the User's access to the App at any time for any reason without notice.

10. Disclaimer of Warranty

The App is provided "as is" and "as available" without any warranties of any kind. Build.Shop does not warrant that the App will be error-free or uninterrupted.

11. Limitation of Liability

Build.Shop shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the User's use of the App.

12. Governing Law

These Terms and Conditions are governed by the laws of the United States. Any disputes arising out of or related to these terms shall be resolved through arbitration in accordance with the rules of the American Arbitration Association.
